10-09-2018 Heard Sri Shailendra Kumar Jha, learned counsel for the petitioner.
The sole petitioner, apprehending his arrest in L.N.M. University P.S. Case No. 83 of 2018 registered for offence under Sections 341, 323, 325, 307, 379 and 506 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.
It has been argued by learned counsel for the petitioner that though in the F.I.R., allegation has been made that petitioner gave iron rod blow on the head of the informant, it did not hit his head, rather the informant received such blow on his right arm. Learned counsel for the petitioner tried to persuade the Court that since petitioner was insisting for
Patna High Court Cr.Misc. No.53716 of 2018(2) dt.10-09-2018 2/2 payment of his arrear wages, which was not paid to the petitioner by the informant since last one year, in a spur of moment, occurrence has taken place, in which, assault was given to the informant.
Be that as it may, since in the F.I.R. itself, there is specific accusation against the petitioner, the petitioner may not be extended the privilege of anticipatory bail. However, if the petitioner appears before the court below and prays for regular bail, the learned court below may examine the same and pass appropriate order in accordance with law, preferably on the same date.
With above observation, the anticipatory bail petition stands disposed of.
