JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Petitioner is not named in the first information report and from perusal of impugned order, I find that in course of investigation, two persons, namely, Manish Kumar (wrongly mentioned in impugned order as Manoj Kumar) and Dharmednra Kumar were arrested, who made their confessional statement leading to recovery of blood stained clothes and materials, which have been used in committing the alleged crime and the aforesaid co-accused persons also disclosed the

Patna High Court CR. MISC. No.65438 of 2019(2) dt.25-10-2019 2/2 name of petitioner as one of the participants in the alleged crime. Moreover, it is informed that co-accused Manish Kumar has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 29.8.2019 passed in Cr. Misc. No. 52844/2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Barauni, Begusarai in connection with Bachhwara Rail P.S. Case No. 8 of 2019.
