Petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 229 of 2017 for offences alleged under Sections 195, 406, 409, 420, 379, 411, 120B/34 of the Indian Penal Code.

The prosecution case, as lodged by the police personnel, is that during investigation of Bhagwanpur P.S.

Patna High Court Cr.Misc. No.56567 of 2018 (2) dt.10-10-2018 2/3 Case No. 227 of 2017 one Sanjeet Kumar Singh was found in possession of Rs. 100000/-, tab and mobile i.e. stolen articles in connection with the F.I.R. lodged by one Ashirbad Micro Finance Ltd Company. The name of other co-accused Ram Udgar Raut also surfaced who on confessional statement took the name of the petitioner.

It has been submitted by the learned counsel for the petitioner that he is innocent, none of the stolen articles or money has been recovered from his possession, bears no criminal history and the confessional statement of the coaccused bear no evidentiary value in the eye of law, moreso nothing has been recovered from the possession of the petitioner.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with
