The petitioner seeks bail in connection with Special (POCSO) Case No. 150 of 2019 arising out of Barh P.S. Case No. 364 of 2019 for the offence under Sections 341, 323, 325, 354(B), 504, 506, 34 and 307 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the parties are having inimical terms due to passage dispute and on account of that the petitioner has falsely been implicated in this case. Neither occurrence as alleged in the F.I.R. has ever taken

Patna High Court CR. MISC. No.65292 of 2019(2) dt.04-11-2019 2/2 place nor anyone has sustained injury. No case under Section 307 of the I.P.C. is made out against the petitioner. The petitioner is rotting in judicial custody since 19.08.2019. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 1st -cumSpecial Judge (POCSO), Patna in connection with Special (POCSO) Case No. 150 of 2019 arising out of Barh P.S. Case No. 364 of 2019.
