====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-02-2024 Heard learned counsel for the petitioner and learned counsel for the State as also learned counsel for the Department of Vigilance.

2. The petitioner in this case is seeking quashing of the first information report giving rise to Dumra P.S. Case No. 16 of 2014 (G.R. No. 202 of 2014) (Spl. Case No. 4 of 2014) registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code, Section 65 of the Information Technology Act, 2000 and Sections 7, 8, 9, 13A of the Prevention of Corruption Act, 1988.

3. Learned counsel for the petitioner submits that the investigation of the case has been kept pending for nine years and when the matter was being persuaded in this Court, in a hurry, the

Patna High Court CR. WJC No.52 of 2023(4) dt.02-02-2024 2/2 investigating agency has filed chargesheet bearing No. 685 of 2023 dated 30.12.2023. Learned counsel has taken this Court through the allegations made in the FIR. As per the allegations, the co-accused who was involved in making of the driving licences and the transport papers disclosed that he was taking Rs.1400-1500/- from the applicants out of which he was paying Rs.400-500/- to this petitioner who was Bada Babu in the District Transport Office.

4. Learned counsel for the State submits that after investigation, the case has been found true and because a large number of vehicles and persons were to be investigated in this case, it has taken some time but at this stage, a chargesheet has already been filed in the learned court below.

5. Having regard to the kind of allegations present in the FIR and upon finding that the case has been found true and the chargesheet has been filed by the Investigating Agency, this Court finds no ground to interfere with the First Information Report or the chargesheet.

6. This application has no merit. It is dismissed.

7. The pleas raised by the petitioner are left open to be taken at appropriate stage.
