2. The petitioner apprehends his arrest in Dhangai P.S. Case No. 05 of 2024 registered for the offences punishable under Sections 8, 15, 25 and 18(C) of the NDPS Act.

3. It is alleged that petitioner is said to be involved in the cultivation of opium plants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposes the prayer for bail and submits that there is specific allegation against the

Patna High Court CR. MISC. No.78246 of 2024(2) dt.21-11-2024 2/2 petitioner that he is involved in the cultivation of opium plants.

6. Considering the specific accusation and the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.

7. However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seeks regular bail and the learned Court below would pass the order in accordance with law.
