2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 392 of the Indian Penal Code.

The case of the prosecution, in short, is that the informant was working as Branch Manager of non-banking financial company and had been carrying Rs. 8,38,800/- which was collected by the informant. The informant and his associate were threatened by two miscreants. It is further alleged that the miscreants snatched the bag containing the cash on gunpoint and both the miscreants fled away on a motorbike on which a youth was already sitting.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. The learned counsel for the petitioner has further submitted that an FIR was lodged against unknown miscreants. During the investigation, one Dhiraj Kumar was apprehended and he had given a confessional statement. The name of this petitioner has surfaced in the confessional statement of Dhiraj Kumar. It has further been submitted that except the confessional statement of co-accused Dhiraj Kumar, there is nothing against this petitioner, no recovery has been made and no TIP was conducted. The learned counsel for the petitioner has submitted that co-accused Dhiraj Kumar has been granted bail by a learned Coordinate Bench of this Court vide Cr. Misc. No. 17909 of 2025. It has been submitted that the case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 26.06.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail stating that the petitioner has five criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on

Patna High Court CR. MISC. No.70885 of 2025(2) dt.09-10-2025 3/3 bail. The above named petitioner is directed to be released on bail in connection with Nayagaon P.S. Case No. 213 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chhapra.
