2. The petitioner has filed the instant application for the following reliefs:

"That this is an application is directed for memo no.- 857 dated - 13.03.2024 (as contained in Annexure- P3) passed by the Civil Surgeon -cum- Chief Medical Officer, Muzaffarpur (respondent no.- 6) by which he has dismissed the petitioner from the service prior to 17 days of his superannuation

Patna High Court CWJC No.16665 of 2025(2) dt.19-11-2025 2/2 ignoring the reply given by the petitioner. Further pray for giving all consequential benefits including increment, Time Bond promotion, ACP and MCP to the petitioner and all retirement benefits amount for which the petitioner is legally entitled."

At the outset, it is submitted by learned counsel for the respondents in reference to the statement made in the interlocutory application that Appeal no. 2 of 2024 has been preferred by the petitioner before the Director-in-Chief, Health Services, Bihar, Patna which has not been decided on merits.

4. Having heard learned counsel for the parties and having perused the contents of the petition, this application is disposed off with a direction to the Director-in-Chief, Health Services, Bihar, Patna (respondent no. 3) to decide the case of the petitioner at the earliest, preferably within a period of three months from the date of receipt/production of a copy of this order.

5. The writ application stands disposed off with the above observations and directions.
