====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has prayed for bail in connection with Excise Complaint Case No. 99 of 2019 registered for the offences under Section 30(a) of Bihar Prohibition & Excise Act. As per allegation in the FIR, 10 litres of illicit liquor is said to have been recovered in the train.

It is submitted by learned counsel for the petitioner that the bag from which the alleged recovery has been made does not belong to the petitioner. It is further submitted that the petitioner has no criminal antecedent and is in custody since 14.08.2019.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.73774 of 2019(2) dt.27-11-2019 2/2 taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Special Court, Banka, in connection with Excise Complaint Case No. 99 of 2019.
