JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-11-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as well as respondents. The petitioner seeks bail in connection with Bettiah Town P.S. Case No. 501 of 2019, registered for the offence punishable under Sections 346, 366(a), 367, 370, 370(a), 372, 373, 376, 120B of the Indian Penal Code, Sections 3, 4, 5, 6, 7 and 8 of the Immoral Traffic Act, Sections 4, 6, 12 and 17 of the POCSO Act and Sections 75 and 81 of the Juvenile Justice Case and Protection of Children Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused person has been granted bail by a
Patna High Court CR. MISC. No.65747 of 2019(2) dt.13-11-2019 2/2 co-ordinate Bench of this Court in Cr. Misc. No. 65264 of 2019 vide order dated 04.11.2019. The petitioner has no criminal antecedent and he is in custody since 06.07.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District Judge-cum-Special Judge (SC/ST/POCSO), Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 501 of 2019.
