The petitioner in the present case is seeking anticipatory bail in connection with Jandaha P. S. Case No. 214 of 2017 registered for the offence punishable under Section 420 of the Indian Penal Code.

Mr. Ansul, learned counsel for the petitioner at the outset has fairly pointed out to this Court that this anticipatory bail application could not have been filed for a simple reason that the Police has already granted bail to the petitioner in terms of the provisions of Cr.P.C. and once the petitioner has availed bail, now after cognizance he is required to appear in the court below. After submission of charge-sheet as and when the court below takes cognizance and decides to issue summons to the

Patna High Court Cr.Misc. No.54520 of 2018(2) dt.08-10-2018 2/2 petitioner he will be obliged to put his appearance in the court below with whatever remedy he has to avail.

In the aforesaid facts and circumstances this application is dismissed.
