====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 28-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Tajpur (Halai O.P.) P.S. Case No. 656 of 2023 dated 06.11.2023 registered for the offences punishable under Section 392 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, three unknown miscreants came on motorcycle and entered the office of C.S.P. Thereafter, they looted Rs. 1,50,000/- on the point of gun and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.72888 of 2025(2) dt.28-11-2025 2/3 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. His name has come in the present case on the basis of his self confessional statement made before the police which has got no evidentiary value in the eyes of law. He has been identified through C.C.T.V. footage is vague and unsubstantiated. It is pertinent to mention that the miscreants had covered their faces with masks or gamchhas, making any such identification is highly doubtful. It is further submitted that the other co-accused Sonu Kumar has already been granted bail by a Bench of this Court in Cr. Misc. No. 38960 of 2025 vide order dated 14.08.2025, annexed as Annexure-P/2 to the present bail petition. The petitioner has six criminal antecedents and in three cases he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 07.02.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,

Case No. 656 of 2023 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be canceled.

7. The application stands allowed.
