JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-12-2020 Heard learned counsel for the petitioner as well as learned Special Public Prosecutor appearing for the Vigilance through video conference.
Petitioner is in jail custody since 15.11.2017 in connection with Gandhi Maidan P.S. Case No. 515 of 2017 registered for the offences punishable under Sections 467, 468, 471, 409, 420, 120B/34 of the Indian Penal Code and Section 13(1)(c)(d) read with 13(2) of Prevention of Corruption Act, 1988.
At the very outset, it is pointed out on behalf of the petitioner that president of trust to which amount in question was allotted has already been granted privilege of bail and similarly, the then executive engineer, namely, Vinay Kumar
Patna High Court CR. MISC. No.68833 of 2019(6) dt.03-12-2020 2/2 Sinha who has been framed in the FIR as main accused has also been granted privilege of bail and apart from this, several other co-accused, having more or less similar allegation, have already been released on bail whereas petitioner being old lady of 63 years is languishing in jail custody since long. Although, learned Special Public Prosecutor appearing for the Vigilance opposed the prayer but he fairly conceded that co-accused Vinay Kumar Sinha and some others have already been granted privilege of bail by different Benches of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-1, Patna in connection with Gandhi Maidan P.S. Case No. 515 of 2017 corresponding to Special Case No. 349 of 2017. (Hemant Kumar Srivastava, J) shahzad/- U T
