The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 386/34 of the Indian Penal Code. The prosecution case, in brief, is that the accused persons demanded ransom from the informant and fired from the roof. It has been submitted on behalf of the petitioners that the petitioner No. 1 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused in this case due to previous enmity. A title suit is also pending between the parties and for the said reason, the prosecution has been brought
Patna High Court Cr.Misc. No.53009 of 2018 (2) dt.20-09-2018 against the petitioners and other co-accused. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Rahui (Bhagan Bigha) P.S. Case No. 229 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
