JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. The petitioners apprehend his arrest in connection with Runnisaidpur P.S. Case No.410 of 2022, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

Accusation is of kidnapping the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the statement of the victim was recorded under Section 164 Cr.P.C. in which she has not supported the prosecution case rather she stated that he out of her own free will, went with the petitioner and solemnized marriage with him. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Considering the facts and circumstances of the case and the statement of victim recorded u/s 164 of the Cr.P.C , let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Session Judge, VI-cum-Special Judge (POCSO Act), Sitamarhi in connection with Runnisaidpur P.S. Case No.410 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
