JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of Vigilance. The petitioner seeks bail in connection with Special Case No. 37 of 2017 (Patrakar Nagar P.S. Case No. 319 of 2017), registered under Sections 406, 409, 419, 420, 467, 468, 471 and 120-B of the Indian Penal Code and Sections 7, 8, 9, 13(i),(c)(d) and 13(2) of the Prevention of Corruption Act. The accusation is that Plot No. 63 area 11 decimal, Plot No. 64 area 20 decimal and Plot No. 72 area 26 decimal of Khata No. 22 of village- Hanuman Nagar are in possession of the South Bihar Power Distribution Company Limited and the boundary over the same is also constructed. In spite of that, the Revenue Karmchari and Revenue Officer issued the Possession
Patna High Court Cr.Misc. No.43142 of 2017 (3) dt.08-11-2017 2/2 Certificate in favour of Devendra Kumar and fixed the land revenue in his favour.
Learned counsel for the petitioner submits that petitioner is Halka Karmchari and he has falsely been implicated in this case. Moreover, after lodging the present case on 27.05.2017, the Sadar Amin submitted his report that the land is not in possession of the Power Grid, Kankarbagh. Further submission is that similarly situated co-accused Kumar Mithlesh Prasad Singh has already been granted privilege of bail by this Court vide order dated 22.09.2017 passed in Criminal Misc. No. 34782 of 2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Vigilance-1, Patna in connection with Special Case No. 37 of 2017 (Patrakar Nagar P.S. Case No. 319 of 2017).
