====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code, Fertilization Control Order, 1985, 7(B)/4 and Section 7 of Essential Commodities Act, 1955.

Petitioner is alleged to be involved in black marketing of fertilizers and seeds.

It is submitted that petitioner is not the proprietor of M/S Jai Mata Dee Khad Beej Bhandar, Nanpur from where 500 bags of urea is said to be recovered. Petitioner is neither owner nor driver of the pick up van in question. The said van was parked in front of the shop of the petitioner and he has been

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (P), Sitamarhi in connection with Nanpur P. S. Case No. 345 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
