2. The petitioner seeks regular bail, who is in custody in connection with S.T. No. 172 of 2022, arising out of Sono P.S. Case No. 198 of 2021, registered for the offences punishable under Sections 302, 384/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Earlier the prayer for bail of the petitioner was accorded by this Court vide order dated 24.08.2022 passed in Cr. Misc. No. 29489 of 2022. While granting bail to the petitioner certain conditions have been imposed that the petitioner will remain present on each and every date of trial till disposal of the case.

Learned Advocate for the petitioner contended that the petitioner was all along cooperating in the trial, but in the meantime on account of some unavoidable reason he had been compelled to go outside the State to earn some money and because of some communication gap between the petitioner and his Advocate, he could not appear physically in the court on 28.09.2022 and 21.03.2023 and later on his bail bond was cancelled and Non-bailable Warrant of Arrest was issued on 28.06.2023. Having come to know that the process has been issued in the case, the petitioner surrendered before the learned court on 30.07.2024 and since then he has been incarceration. Learned Advocate for the petitioner further contended that the petitioner undertakes that he will abide by the undertaking or the conditions imposed by this Court.
5. On the other hand, learned APP for the State vehemently opposes the bail application.
6. Regard being had to the submissions made on behalf of the parties and considering the fact that the petitioner had already been granted bail by this Court vide order dated 24.08.2022 passed in Cr. Misc. No. 29489 of 2022 and now he undertakes that he will abide by the conditions, as has been imposed, let the petitioner, named above, be released on bail on
