2. The petitioners seek regular bail in connection with Sahar P.S. Case No. 175 of 2025 registered for the offence under section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022.

3. As per prosecution story, the police got a secret information that two persons were transporting illicit liquor in plastic bags from Baruhi towards Sahar. When the police reached there, the accused persons threw the liquor and tried to flee. After chasing them, the police apprehended them who disclosed their names as Tutu Choudhary and Praduman Kumar (petitioners) and on search the police recovered 82.500 litres of

4. Learned counsel for the petitioners submits that the petitioners are innocent and have no criminal antecedent. He further submits that the petitioners are in custody since 02.09.2025 without any fault.

5. Learned counsel for the petitioners also submits that the petitioners are ready to donate Rs.25,000/- each in some charitable organization without accepting his guilt

6. Learned APP appearing for the State opposes the prayer of the petitioners for grant of bail.

7. Considering the facts and circumstances of the case as well as the submissions of learned counsel for the petitioners, this application is allowed.

8. Let the petitioners, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court-II, Ara/ concerned Court below, in connection with Sahar P.S. Case No. 175 of 2025.

9. This is also subject to the condition that the petitioners shall deposit an amount of Rs. 25,000/- each in
