The petitioner seeks pre-arrest bail in connection with Complaint Case No. 133 C of 2017 in which cognizance has been taken under Sections 406, 420 and 465 of the Indian Penal Code.
Regard being had to the nature of the offence and the fact that prior to the institution of the present complaint, the petitioner had already filed Complaint Case No. 1998 C of 2016
Patna High Court Cr.Misc. No.41516 of 2017 (2) dt.19-09-2017 2/2 in the court of Chief Judicial Magistrate, Bhabhua on 18.11.2016 regarding dishonour of the cheque issued by the complainant's husband, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in Complaint Case No. 133 C of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
