Petitioners apprehend their arrest in Rajauli P.S. Case No.258 of 2019, registered under Sections 147, 341, 323, 324 and 307 of the Indian Penal Code.

The informant alleged that while he was standing on his Darwaza, his own brother, Prabhu Yadav, petitioner no.1, Rajaram Prasad, Ramashish Yadav, Runti Devi, petitioner no.3 and Sharda Devi, petitioner no.2 came and began to abuse the informant. When the informant forbade, Rajaram Prasad assaulted him with Tangi on his head. On alarm, his brother Shankar Prasad and sister-in-law Sunaina Devi came but the accused persons also assaulted them.

No.70564 of 2019(3) dt.18-12-2019 2/2 Learned counsel for the petitioners submits that the petitioners are of course named in the FIR but no specific allegation of assault is made against the petitioners. Rajaram Prasad is alleged to have assaulted the informant with Tangi on his head. Petitioner No.1, Prabhu Yadav is the own brother of the informant. Petitioner No.2 is the wife of petitioner no.1 and petitioner no.3, Runti Devi is the wife of Raja Ram. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Rajauli P.S. Case No.258 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
