Mr. SRI ARUN KUMAR SINGH -5 ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Mali P. S. Case No. 32 of 2017 registered for the offences punishable under Sections 406, 420 of the Indian Penal Code. Allegedly, the petitioners and others were running Brick Kilns without obtaining licenses and no objection certificates from the respective departments in spit of direction of the Bihar Pollution Control Board, Patna to close the Brick Kiln. Submission is of false implication and that the petitioner has already deposited the license fee and also fee for getting no objection certificate from Bihar State Pollution Control Board, Patna vide annexure- 2 series and as such the petitioner deserves sympathetic consideration. Further similarly

Patna High Court Cr.Misc. No.44418 of 2017(2) dt.21-09-2017 2/2 situated co-accused have already allowed pre-arrest bail. Learned APP submits that at the time of inspection the petitioner has not shown the relevant papers. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P. S. Case No. 32 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
