The petitioner seeks pre-arrest bail in connection with Hisua P.S. Case No. 250 of 2014 registered under Sections 498A and 494 of the Indian Penal Code.
It is contended by the learned counsel for the petitioner that there is no truth behind the allegation that the petitioner subjected the informant to cruelty for non-fulfilment of demand of dowry rather the fact is that the instant first information report has been instituted due to matrimonial discord and incompatibility. It is further contended that the
Patna High Court Cr.Misc. No.57606 of 2018 (2) dt.28-09-2018 2/2 petitioner is still willing to keep the informant with full dignity and honour in her matrimonial home but, she herself deserted him.
Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S. Case No. 250 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C.
