08-10-2018 Heard Sri Ratanakar Jha, learned counsel for the petitioner and Smt. Sucheta Yadav, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Jaynagar P.S. Case No. 250 of 2018 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has referred to paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner only on suspicion has been made accused in the present case, otherwise, nothing was recovered from conscious possession of the petitioner. He further submits that other two co-accused, having similar accusation, have been extended the

Patna High Court Cr.Misc. No.62118 of 2018(2) dt.08-10-2018 2/2 privilege of anticipatory bail, vide order dated 04-09-2018 passed in Cr.Misc. No. 52747 of 2018.

Learned Addl. Public Prosecutor, though has opposed the prayer for grant of anticipatory bail, has not disputed the fact that other two accused persons have been extended the privilege of anticipatory bail.

Since other two accused, in similar circumstances, have been granted anticipatory bail, there is no reason to pass a different order in the present case.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Arvind Kumar Yadav @ Arvind Kumar @ Arvind Lagrvar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II-cum-Special Judge, Excise Act, Madhubani in connection with Jaynagar P.S. Case No. 250 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
