JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 438/2019, disclosing offences under Sections 30 (K) and 56 (Kh) of Bihar Prohibition and Excise Act.
Allegation is of recovery of 30 litres of liquor from the scooty and two persons arrested on the spot and it is alleged that petitioner is the owner of the scooty.
Submission of learned counsel for the petitioner is that the has been made accused in this case only because he happens to be owner of the scooty and except that there is no allegation against him and the persons, who were arrested on spot has not disclosed the name of the petitioner as their associate in liquor trade.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya, in connection with Excise Case No. 438/2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
