JUSTICE BIRENDRA KUMAR ORAL ORDER 06-09-2017 It appears that the petitioners were allowed anticipatory bail in Cr. Misc. No. 36166/2017 on 10.08.2017 in connection with Bhagwanpur P.S. Case No. 22/2017. Submission of the learned counsel for the petitioners is that due to inadvertence, the offence under Section 27 of the Arms Act could not be typed in the bail petition, which is alleged in the F.I.R. Consequently, in the order aforesaid, it is not mentioned that offence under Section 27 of the Arms Act is there. In my view, for that technical reason, the court below should not have refused to accept the bail bond of the petitioners because in the order dated 10.

08.2017 it has already been stated that the allegation against the petitioners is that they assaulted the husband of the informant with lathi and butt of gun. Hence, nothing was suppressed in this bail matter.

Patna High Court Cr.Misc. No.42320 of 2017 (2) dt.06-09-2017 2/2 of the petitioners soon after receipt of a copy of this order or within three weeks from the date of production of a copy of this order.

With the aforesaid observation, this modification application stands disposed of.
