====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-08-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 420, 406/34 of the Indian Penal Code.
3. As per the prosecution case, petitioners took Rs.4 lacs from the informant and agreed to marry her daughter but later on they refused and also did not return the said amount.
4. It is submitted on behalf of the petitioners that informant's daughter has already been married to some other person and informant has lodged this FIR only with revengeful
Patna High Court CR. MISC. No.74476 of 2023(8) dt.19-08-2024 2/2 motive. As a matter of fact, informant had only given a ring as gift which, the petitioners are ready to return anytime. Petitioners claim clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in Majhauliya Police Station Case No. 114 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
