JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Piri Bazar P. S. Case No. 83 of 2019, disclosing offences under Sections 147, 148, 149, 307, 353 of the Indian Penal Code and Section 27 of the Arms Act and Section 16, 17, 18, 20, 23 and 28 of the Unlawful Activities (Prevention) Act, 1967.

As per F.I.R. several persons are named in the F.I.R. including the petitioner, as the police raided the place of the Nuxalites. There was firing from both sides. It further appears that in the School several articles of the Naxalites were kept. Petitioner happens to be the Teacher of the school. He is accused in one more case.

Submission of the learned counsel for the petitioner is that there is no specific allegation of any firing by the petitioner

Patna High Court CR. MISC. No.64624 of 2019(2) dt.16-10-2019 2/2 or any other act. He is ready to abide by any condition imposed upon him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Lakhisarai, in connection with Piri Bazar P. S. Case No. 83 of 2019 , subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate the Investigating Officer and appear as and when required.
