This application has come for modification in order dated 28.6.2018 passed in Cr. Misc. No13616 of 2018 by which the petitioner was directed to surrender within a period of eight weeks along with bank draft of Rs.50,000/- payable in the name of the complainant and once he will deposit the same he shall be released on bail on payment of rest of the amount of Rs.01 lac within five months.

Submission of the learned counsel for the petitioner is that he has deposited Rs.50,000/- and he is on provisional bail and he has also deposited Rs.20,000/- and in respect of the rest of the amount he is unable to deposit as her husband is bed ridden. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.59493 of 2018 (2) dt.26-09-2018 2/2 circumstances, as stated above, I am not inclined to interfere with the earlier order, however, the liberty is given to the petitioner to deposit the rest of the amount within further five months from the date of receipt of the order.

With the aforesaid observation, this application is disposed of.
