Mr. None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Sunil Kumar Singh, learned counsel for the petitioners. None appeared on behalf of the State. Three petitioners, apprehending their arrest in Patepur P.S. Case No 131 of 2018 registered for offence under Sections 363, 366 (A) of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender. Learned counsel for the petitioners submits that of course in the F.I.R., petitioners were arrayed as accused, but during investigation statement of victim girl was recorded under Section 164 of the Code of Criminal Procedure and after going through her statement, it is evident that allegation made in the F.I.R. against the petitioners appears to be not correct. It has been argued that petitioner no. 1 is the brother of the main accused, who had allegedly taken away the daughter of the
Patna High Court Cr.Misc. No.58763 of 2018(2) dt.20-09-2018 2/2 informant, petitioner no. 2 is mother of petitioner no. 1, whereas petitioner no. 3 is the sister of petitioner no. 1. Besides hearing, I have also perused the material available on record, particularly the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, which has been brought on record as Annexure-2 to the petition and after going through the same, I am of the opinion that it is a fit case for grant of anticipatory bail.
Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid three petitioners, namely, (i) Channu Singh @ Chunnu Singh (ii) Rita Devi and (iii) Anjali Kumari be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub JudgeXI-cum-A.C.J.M.,Vaishali at Hajipur in connection with Patepur P.S. Case No.131 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
