1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Supaul P.S. Case No. 588 of 2019 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379 of the I.P.C.
3. The allegation in the first information report is that the petitioner assaulted the brother-in-law of the informant with spade on his head due to which he sustained head injury.
4. Learned counsel for the petitioner submits that the petitioner along with other family members have been made accused due to land dispute between the parties. A counter case has also been lodged by the side of the petitioner bearing Supaul P.S. Case No. 587 of 2019 in which the side of the petitioner has sustained injury and one family member of the side of the petitioner also died. The injury caused to the victim as would be
Patna High Court CR. MISC. No.78384 of 2024(2) dt.04-12-2024 2/2 evident from the impugned order is simple in nature. Other four accused persons have been granted bail by the learned Additional Sessions Judge-V, Supaul by the same impugned order.

Regard being had to the submission made by the parties, taking into consideration the fact that the occurrence has taken place due to land dispute, both the parties are co-villagers, case and counter is there and injury caused to the victim is simple in nature, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Supaul in connection with Supaul P.S. Case No. 588 of 2019 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
