JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 08.10.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Digha P. S. case no. 418/2017 registered under section 307 and other allied sections of the IPC.

Although petitioners are named in the FIR but according to the FIR itself some unknown persons opened fire on the informant on the instigation of co-accused Mukesh Roy. However, co-accused Santosh Roy @ Santosh Kumar having more or less similar allegation has already been admitted to anticipatory bail by a coordinate bench of this court vide order dated 10.5.2018 passed in Cr. Misc. no.

Patna High Court Cr.Misc. No.60663 of 2018 (2) dt.08-10-2018 13464/2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Patna in Digha P. S. case no. 418/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
