1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 117(2) and 109 of the B.N.S.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on account of dispute relating to land, the accused persons including the petitioners came and assaulted his father causing injury on leg and also assaulted Manisha by khanti causing injury on head.

4. Learned counsel for the petitioners submits that

It is next submitted that from perusal of the allegation as alleged in the F.I.R. it would manifest that on account of dispute relating to land, the occurrence is alleged to have been committed. It is next submitted that since a land dispute was going between the parties as such an altercation took place in which both side assaulted each other. It is next submitted that no doubt there is an allegation of assaulting the father of the informant and Manisha but then the allegation of assault is not specific. It is also fairly submitted that the order impugned records that the injury suffered by the father of the informant has been opined to be grievous and had suffered multiple bruises but then it is reiterated and submitted that allegation of assault is not specific and petitioners are not criminals.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the fact that petitioners are persons with clean antecedent and no specific allegation of assault is alleged, the petitioners abovenamed, in the event of their arrest or surrender before the

No.71740 of 2025(2) dt.15-10-2025 3/3 learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Bypass P.S. Case No.43/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. (Satyavrat Verma, J) amit/- U T
