JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 This application, for grant of anticipatory bail, arises out of Aurangabad (M) P.S. Case No. 176 of 2019, disclosing offences under Sections 406 and 420 of the Indian Penal Code. Allegation as per F.I.R. is that informant was running a registered firm later on petitioner and others also joined in the said firm and a sum of Rs. Fifty Lakh was deposited in the account of the firm, which was transferred by this petitioner in his account. Submission of learned counsel for the petitioner is that the person, who deposited Rs. Fifty Lakh in the account, has no grievance and he has stated clearly that he has given the amount to the petitioner for the work he has done, which will appear from annexure -3 and petitioner has falsely been implicated in this case. Further submission is that if there is any dispute with regard to any agreement, the complainant is always at liberty to seek the arbitration

Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant opposed the prayer for anticipatory bail and submitted that third agreement between the petitioner and the informant was not registered, wheres earlier agreements were registered and he got the amount of firm transferred in his account.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (M) P.S. Case No. 176 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

With further subject to condition that petitioner will cooperate in investigation and make himself available as and when require by the investigating officer.
