The petitioner seeks pre-arrest bail in connection with Lalganj P.S. Case No.262 of 2018 registered under Sections 341, 323, 353 and 504 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that save and except Section 353 of the Indian Penal Code, all other offences are bailable in nature. So far as Section 323 of the I.P.C. is concerned, in the instant case the petitioner has neither used any force or assaulted any one nor damaged any property rather the fact is that he was abused by the staff of the Sub-Registry.

Patna High Court Cr.Misc. No.57502 of 2018 (2) dt.28-09-2018 2/2 Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. Having regard to the facts and circumstances of the case and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No.262 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
