1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in Kasim Bazar P. S. Case No.166 of 2025 registered for the offences punishable under Sections 25(1)(b), 25(1)(a), 26, 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that he received an information that Amit, petitioner and Prinyanshu have concealed arms behind the house of Amar. Accordingly, the informant reached the place of occurrence and Amit was apprehended and from his possession, country-made pistol along with empty magazine was recovered along with other articles and Amit disclosed the name of petitioner and

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that the name of the petitioner transpired in the confessional statement of apprehended accused in police custody which does not have any evidentiary value. It is also submitted that petitioner was not found at the place of occurrence. It is next submitted that informant alleges in the FIR that he received a secret information that accused have concealed the arms behind the house of Amar, as such, the informant through Amit got the petitioner implicated.

Learned A.P.P. opposes the anticipatory bail application and submits that no doubt, the name of the petitioner transpired in the confessional statement of apprehended accused, but then, apprehended accused disclosed that this petitioner along with Priyanshu indulged in selling arms. It is also submitted that petitioner has antecedent of one case and investigation is continuing and if privilege of anticipatory bail is granted, the petitioner may abscond.

6. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. The prayer of the petitioner for anticipatory bail stands rejected.
