2. The petitioner seeks bail in connection with Bahera P.S. case No. 228 of 2023 instituted for the offences under Section 392 of the Indian Penal Code.

3. As per the prosecution case, two persons on one motorcycle stopped the pick-up van bearing registration no. BR 07 GB 7619 and at the point of pistol, both miscreants snatched the bag containing Rs. 8-9 lakhs along with mobiles of driver, Rakesh Kumar and staff, Dilip Kumar and fled away by making fire in the air.

4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.06.2023 and has no criminal

The petitioner is not named in the F.I.R. and the name of the petitioner came into light on the basis of the confessional statement of co-accused Vijay Kumar Yadav who has already been granted bail by the co-ordinate Bench of this Court vide order dated 28.11.2023 passed in Cr. Misc. No. 73919 of 2023. No T.I.P. has been conducted till now. He further submitted that nothing incriminating has been recovered from the conscious possession of the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bahera P.S. case No. 228 of 2023.
