2. The instant petition has been filed against the order dated 05.08.2023 passed by learned District Judge, Bhojpur, Ara in Title Appeal No. 4 of 2023 whereby and whereunder the said title appeal has been dismissed at the stage of admission. Evidently, the present miscellaneous petition is not maintainable against the said order.

3. Faced with the situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail appropriate remedy.
