2. The petitioner apprehends arrest in connection with Gogari P.S. Case No. 27 of 2025 dated 03.02.2025, registered for the offence punishable under Sections 126(2), 115(2), 109, 329(3) and 352 of Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he along with other co-accused attacked the informant with sticks on his legs, hands and body. The petitioner is said to have assaulted on the head of the informant by means of gandasa.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that there is specific allegation against the petitioner that he assaulted by means of gandasa on the head of

The doctor has opined that there was no bony or abrasion injury. Only a scar mark on little finger of left hand has been found. The nature of injury is mentioned as simple in nature. It is submitted that the petitioner is an advanced age person aged about 74 years. Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Gogari P.S. Case No. 27 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to condition as laid down under Section 482(2) of B.N.S.S..
