The petitioner seeks bail in anticipation of his arrest in connection with Gopalpur P.S. Case No. 235 of 2018 dated 28.06.2018 instituted for the offence under Sections (25-B)A, 26, 35 of the Arms Act.

The implication of the petitioner in the present case is on the basis of confession made by two of the accused persons who were arrested and from whose possession, firearms have been recovered.

The petitioner does not have any criminal antecedent.

Considering the aforestated facts as also taking into account that nothing has been recovered from the possession of the petitioner and his implication is only on

No.57779 of 2018(2) dt.11-12-2018 2/2 the basis of confession of a co-accused, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st Naugachia, Bhagalpur in connection with Gopalpur P.S. Case No. 235 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
