JUSTICE SUDHIR SINGH ORAL ORDER 16-01-2018 Heard learned counsel for the petitioner, learned counsel appearing for the State and learned counsel for the informant.

The petitioner is apprehending his arrest in a case instituted under Sections 323, 341, 504, 506, 498A, 302/34 of the Indian Penal Code and 3/4 of D.P. Act.

The allegation against the petitioner is of committing murder of the deceased due to non-fulfillment of the demand of dowry.

It has been submitted on behalf of the petitioner there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner was made accused in one more case, in which

Patna High Court Cr.Misc. No.49220 of 2017 (4) dt.16-01-2018 2/2 the police, after investigation, submitted final form against the petitioner. The petitioner is father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. The husband of the deceased is already in custody. The other coaccused have been granted bail Vide Cr. Misc. No.43319/2017, Cr. Misc. No. 46713 of 2017, Cr. Misc. No. 47923 of 2017 and Cr. Misc. No.48283 of 2017.

On behalf of the State and counsel for the informant, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Bihar P.S. Case No.344 of 2017, on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Biharsharif, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
