The sole petitioner, apprehending her arrest in connection with Chapra Town P.S. Case No. 229 of 2018 , registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of her arrest or surrender.
Learned counsel for the petitioner submits that one auto was purchased in the name of the petitioner by her husband in the year 2005 while he was alive and during his life time he had already sold the vehicle to another person and in the present case petitioner has been made accused on an accusation that she is the registered owner of the said auto which was intercepted by the Police and from the said auto huge quantity
Patna High Court Cr.Misc. No.59961 of 2018(2) dt.06-10-2018 2/2 of mahua liquor was shown to be recovered. At the time of interception of the vehicle two accused persons were arrested and even they did not disclose the name of the petitioner. Considering the nature of accusation, clean antecedent of the petitioner as well as the fact that petitioner is a lady , in the event of her arrest or surrender within a period of six weeks from today, let the petitioner Leela Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned 6th ADJ Saran - cum- Special Judge , Excise, Saran at Chapra / concerned court in connection with Chapra Town P.S. Case No. 229 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
