2. The petitioner is apprehending his arrest in a case in connection with Balia P.S. Case No. 296 of 2023 dated 22.10.2023 registered for the offences punishable under Sections 420, 467, 468, 471, 384 and 448/34 of the I.P.C.

3. As per the prosecution case, the informant's land was sold by the accused persons on the basis of forged documents. It is further alleged that on 09.07.2023 when the witness nos. 1, 2 and 3 of the complaint were doing work on the said land then the accused persons came and abused him and demanded rangdari of Rs. 50,000/-.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is neither the seller nor the

Patna High Court CR. MISC. No.74742 of 2024(2) dt.06-02-2025 2/2 buyer of the said land. The name of the petitioner has not figured anywhere in the said sale deed. There is general and omnibus allegation against the petitioner. The petitioner has no concern with the alleged offence. The co-accused persons have already been granted anticipatory bail by this court vide order dated 13.12.2024 passed in Cr. Misc. No. 71024 of 2024. The petitioner has four criminal antecedents as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Begusarai in connection with Balia P.S. Case No. 296 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
