2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354(B), 379, 447, 448, 506/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.

3. Prosecution case, in brief, is that on the alleged date and time of the occurrence, all the F.I.R. named accused persons including this petitioner entered the shop of informant and looted ornaments worth Rs. 70,000/- and cash. It is further alleged that this petitioner misbehaved with the informant.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.75879 of 2024(3) dt.22-01-2025 2/2 petitioner has falsely been implicated in this case only with a view to save their skin from Dariyapur P. S. Case No. 259 of 2024 which was lodged by the daughter of petitioner against the informant and others. Both parties are co-villagers. Allegation against the petitioner is general and omnibus. Petitioner claims clean antecedent.

5. Learned counsel for the informant vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Additional Sessions Judge (POCSO), Saran at Chapra in connection with Dariyapur P. S. Case No. 270 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
