The petitioner in the present case is seeking regular bail in connection with Bettiyah Town P.S. Case No.501 of 2019 registered for the offence punishable under Sections 346, 366A, 367, 370(A), 372, 373, 376 and 120B of the Indian Penal Code , Sections 3, 4, 5, 6, 7 and 8 of Immoral Traffic Act, 1956, Sections 4, 6, 12 and 17 of the Protection of Children From Sexual Offences (POCSO) Act, 2012 and Section 75/81 of the Juvenile Justice Care and Protection of Children Act, 2015. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that similarly situated accused have been granted privilege of regular bail in Cr.Misc.No.69347 of 2019,
Patna High Court CR. MISC. No.65627 of 2019(3) dt.23-01-2020 2/3 Cr.Misc.No.65747 of 2019 and Cr.Misc.No.65264 of 2019. Learned APP has opposed the prayer for bail.
Considering the facts and circumstances of the case wherein the submission of learned counsel for the petitioner that similarly situated accused have been granted privilege of regular bail in Cr.Misc. No.69347 of 2019, Cr.Misc.No.65747 of 2019 and Cr.Misc.No.65264 of 2019 remains uncontroverted by learned APP for the State and the petitioner being in custody since 06.07.2019 having no criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, SC/ST/POCSO, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No.501 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C.
