2. The petitioner seeks bail in connection with Nawanagar (Sonvarsha O.P.) P.S. Case No. 325 of 2023 instituted for the offences under Section 392 of the Indian Penal Code.

3. As per prosecution case, when the Informant was going to his home by his car, three unknown persons came on a white motorcycle, stopped his car by overtaking and snatched the bag containing Rs. 1,00,000/- on the gun point.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. and his

Patna High Court CR. MISC. No.77217 of 2023(2) dt.05-12-2023 2/2 name has surfaced in the present case on the basis of the confessional statement of co-accused/Suraj Bhan Singh. Learned counsel for the petitioner further submits that nothing incriminating has been found from the conscious or physical possession of the petitioner. No TIP has been conducted by the police up-till now. The petitioner has four criminal antecedents including the present one and in all the three cases, he is on bail.

5. The petitioner is in custody since 14.08.2023.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering the entire facts and circumstances of the case and taking into account the nature of offence as alleged against the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nawanagar (Sonvarsha O.P.) P.S. Case No. 325 of 2023.
