The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 353, 307, 332, 333, 427, 504 and 379/411 of the Indian Penal Code r/w Section 3 / 4 of Prevention of Damage of Public Property Act, 1984 & MMDR Act 1957 and Section 21 of Bihar Minerals (Concession Prevention of Illegal Mining Transportation & Storage) Rules, 2019 amended Rules 2021, Rules 56(2) As per prosecution case, three tractors loaded with illegally mined sand were intercepted and it is alleged that this petitioner alongwith others fled away, who were identified by the local chowkidar.

It is submitted on behalf of petitioner that there is no specific allegation of overt act against this petitioner. He is

Patna High Court CR. MISC. No.1558 of 2023(3) dt.03-04-2023 2/2 neither owner nor driver of any of the seized tractors and only on suspicion, he has been made accused in this case. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jamui in connection with Laxmipur P.S. Case No. 316 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
