The petitioners are languishing in custody in a case registered for the offences punishable under Sections 171, 414, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

The petitioners were found checking a medical shop without having valid authorization.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.75198 of 2023(2) dt.30-11-2023 2/3 petitioners that petitioners are innocent and they have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. The petitioners are resident of surrounding locality and the informant who is indulged in blackmarketing and when these petitioners raised objection, then he has falsely implicated the petitioners in the present case with a concocted story. The vehicle in question belongs to one Babujan Dewan. The petitioner is languishing in custody since 26.08.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
