2. The petitioner has preferred this application for grant of regular bail in connection with Ben P.S. Case No. 94 of 2024 dated 19.07.2024 registered for the offences punishable u/ss 80(2), 61(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the co-accused persons are alleged to have committed murder of the informant's sister by administering poison to her due to non-fulfillment of demand of dowry. It is further alleged that the co-accused, Dharambir Kumar had an illicit relationship with the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. There is a delay of six days in

Patna High Court CR. MISC. No.71464 of 2025(2) dt.28-11-2025 2/2 lodging the F.I.R. and there is no explanation for this delay. The petitioner is the co-villager of the deceased and she has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is a lady who is in custody since 20.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda at Biharsharif in connection with Ben P.S. Case No. 94 of 2024.

7. The application stands allowed.
