2. No representation is there on behalf of the O.P. No. 02 despite valid service of notice.
3. This is an application for modification to some extent in the order dated 22.02.2024 passed in Cr. Misc. No. 8359 of 2024 by this Court.
4. As per the prosecution case, petitioner is said to have kidnapped the victim girl.
5. The learned counsel for the petitioner has submitted that the petitioner and the victim girl had got married and
Patna High Court CR. MISC. No.76994 of 2024(3) dt.07-02-2025 2/2 subsequently the girl has supported the allegation of kidnapping. The petitioner is in jail since 21.08.2023.
6. Considering the facts and circumstances of the case as well as the period of custody, the order dated 22.02.2024 passed in Cr. Misc. No. 8359 of 2024 is modified to the extent that the Court below is not required to verify the fact that the victim girl eloped from her house voluntarily and presently the petitioner and victim girl are married to each other.
7. The petitioner shall be released forthwith as directed earlier vide order dated 22.02.2024 passed in Cr. Misc. No. 8359 of 2024.
8. With the aforesaid direction, this modification application is allowed.
